US Court Mandates Freedom of Kilmar Abrego Garcia from Immigration Detention
A court has ruled the immediate discharge of Kilmar Abrego Garcia from detention by ICE, finding his ongoing confinement lacks legal authority.
"Since his return from erroneous detention in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis stated in her ruling.
The case stems from a mistaken deportation to El Salvador in March, which the government later acknowledged was an error. Following his repatriation to the United States to face alien smuggling charges, he was held in federal custody.
In her decision, the court pointed out that the government lacks a valid removal order, which effectively blocks them from removing Mr. Abrego Garcia "at this juncture."
Context of the Legal Challenge
The legal challenge center on disputed claims. While the Trump administration contends that Abrego Garcia is a member of the MS-13 criminal organization, he vehemently disputes this claim.
He has also pleaded not guilty to the smuggling counts, which are part of a ongoing trial in Tennessee.

The court, who was overseeing his challenge to removal in a federal court, determined that he must now adhere to the terms of his bond from custody in Tennessee. This order shifts his supervision to the Tennessee court.
